Terms of Service

ThriftSpot is an AI-powered thrift discovery platform that helps users:

• Scan items using your device's camera to receive AI-powered identification and market value estimates
• Discover local treasures on an interactive map showing items spotted by other users
• Pin locations to share where you found items with the community
• Connect with eBay to create listings and sell items
• Reserve items that other users have pinned
• Message other users about items and pickups

We use artificial intelligence to analyze photos and provide value estimates. These estimates are for informational purposes only and should not be considered professional appraisals.

To use certain features of ThriftSpot, you must create an account. When you register, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 13 years old to create an account. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

ThriftSpot uses a token system for certain features:

• Earning tokens: You can earn tokens by creating pins, referring friends, and other activities
• Spending tokens: Tokens are used to scan items and access premium features
• Purchasing tokens: Additional tokens may be purchased through the app

Refund Policy: Token purchases may be refunded at ThriftSpot's discretion on a case-by-case basis. To request a refund, please contact us at found@thriftspot.app.

Tokens have no cash value and cannot be exchanged for cash. Unused tokens do not expire but may be forfeited if your account is terminated for violation of these Terms.

You retain ownership of content you submit to ThriftSpot, including photos, pins, and listings ("User Content"). By submitting User Content, you grant ThriftSpot a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating the service.

You represent that you have the right to submit your User Content and that it does not violate any third-party rights. You agree not to submit content that:

• Infringes intellectual property rights
• Contains false or misleading information
• Is illegal, harmful, or offensive
• Promotes counterfeit or stolen goods
• Contains personal information of others without consent

ThriftSpot allows you to connect your eBay account to create and manage listings. When you use this feature:

• You authorize ThriftSpot to access your eBay seller account
• You remain responsible for all listings created through ThriftSpot
• You must comply with eBay's terms of service and policies
• ThriftSpot is not responsible for eBay transactions or disputes

You can disconnect your eBay account at any time through your account settings.

You agree not to:

• Use ThriftSpot for any unlawful purpose
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the service
• Interfere with or disrupt the service
• Use automated systems to access the service without permission
• Circumvent any security measures
• Collect user information without consent
• Use the service to facilitate the sale of stolen or counterfeit goods

ThriftSpot and its content, features, and functionality are owned by ThriftSpot and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our service without our prior written consent. You may not reverse engineer or attempt to extract the source code of our software.

Service Provided "As Is": ThriftSpot is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

Value Estimates: AI-generated value estimates are for informational purposes only. We do not guarantee the accuracy of any pricing information or market data. You should not rely solely on our estimates when making buying or selling decisions.

User Transactions: ThriftSpot is not a party to transactions between users. We do not verify the quality, safety, or legality of items listed or the accuracy of listings.

Third-Party Services: We are not responsible for the actions or policies of third-party services, including eBay.

To the maximum extent permitted by law, ThriftSpot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

Our total liability for any claims arising from your use of the service shall not exceed the amount you have paid to ThriftSpot in the twelve months preceding the claim.

You agree to indemnify and hold harmless ThriftSpot, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

You may terminate your account at any time by contacting us or through your account settings.

We may suspend or terminate your account at any time for any reason, including if we believe you have violated these Terms. Upon termination:

• Your right to use the service will immediately cease
• Your User Content may be deleted
• Any unused tokens may be forfeited

Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date.

Your continued use of ThriftSpot after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the service.

Entire Agreement: These Terms constitute the entire agreement between you and ThriftSpot regarding your use of the service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
